1. Agreement to Terms
These Terms of Service (“Terms”) govern your access to and use of the website sleepbiome.com (“Site”), products, and services offered by Sleepbiome Labs (“Company,” “we,” “us,” or “our”). By accessing the Site, placing an order, or using any of our services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Site or purchase our products.
We reserve the right to update or modify these Terms at any time without prior notice. Changes become effective immediately upon posting to this page. Your continued use of the Site after any changes constitutes acceptance of the revised Terms. We encourage you to review this page periodically.
2. Eligibility
You must be at least 18 years of age to use this Site or purchase our products. By placing an order, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into a binding agreement.
3. Products and Product Information
Sleepbiome Labs mouth tape is a general wellness product designed to encourage nasal breathing during sleep. It is not a medical device, pharmaceutical product, or treatment for any medical condition including but not limited to sleep apnea, obstructive sleep disorder, or any other diagnosed respiratory condition.
Our products are not intended to diagnose, treat, cure, or prevent any disease. Statements made on this Site regarding our products have not been evaluated by the U.S. Food and Drug Administration (FDA). If you have a medical condition, are currently under medical treatment, or have concerns about whether mouth taping is appropriate for you, consult your physician or healthcare provider before use.
We make reasonable efforts to display product colors, images, and descriptions accurately on the Site. However, we cannot guarantee that your device’s screen will display colors accurately, and minor variations in packaging design may occur between production batches.
4. Contraindications and Safety
Do not use Sleepbiome Labs mouth tape if any of the following apply to you:
- You have severe nasal congestion, a deviated septum, or any condition that significantly obstructs nasal airflow
- You are experiencing a cold, sinus infection, allergies, or any temporary condition that impairs nasal breathing
- You have consumed alcohol or sedatives that may impair your natural breathing reflexes
- You suffer from severe respiratory conditions or breathing disorders unless specifically directed by your physician
- You have nausea or vomiting
- You have open wounds, sores, or active skin infections on or around the mouth and lip area
- You are under the age of 18
If you experience any discomfort, difficulty breathing, or skin irritation while using our product, remove the tape immediately and discontinue use. If symptoms persist, consult a healthcare professional.
Sleepbiome Labs is not liable for any injury, adverse reaction, or health consequence resulting from the use or misuse of our products. By purchasing and using our products, you acknowledge that you have read and understood these contraindications and accept full responsibility for determining whether the product is suitable for your individual health circumstances.
5. Ordering and Payment
When you place an order through our Site, you are making an offer to purchase the selected products subject to these Terms. All orders are subject to acceptance and product availability. We reserve the right to refuse or cancel any order for any reason, including but not limited to product availability, errors in pricing or product information, or suspected fraudulent activity.
Prices are listed in U.S. dollars (USD) and are subject to change without notice. Any price changes will not affect orders that have already been confirmed. Applicable sales tax is calculated and added at checkout based on your shipping address and applicable state and local tax laws.
We accept payment via Visa, Mastercard, American Express, Apple Pay, Google Pay, and other payment methods displayed at checkout. Payment is processed securely through our third-party payment processor (Square). Sleepbiome Labs does not store your full credit card number on our servers.
By submitting payment, you represent and warrant that you are authorized to use the payment method provided and that the billing information you supply is accurate and complete.
6. Subscriptions
Certain products are available on a Subscribe & Save basis. By enrolling in a subscription, you authorize Sleepbiome Labs to automatically charge your payment method at the recurring interval you selected (monthly, every 3 months, every 6 months, or annually) until you cancel.
You may cancel, pause, skip, or modify your subscription at any time through your customer portal. Cancellation takes effect immediately and prevents future charges. You will not be charged again after cancellation.
Changes to your subscription (cancellation, pause, skip, plan change) must be made at least 48 hours before your next scheduled shipment date to take effect for that billing cycle. If a charge has already been processed but the order has not yet shipped, contact us at care@sleepbiome.com and we will cancel the shipment and issue a full refund for that charge.
We will never impose cancellation fees, require phone calls to cancel, or make the cancellation process intentionally difficult.
7. Shipping and Delivery
Shipping terms, delivery timelines, and costs are detailed in our Shipping Policy, which is incorporated into these Terms by reference. By placing an order, you agree to the terms outlined in our Shipping Policy.
Title and risk of loss for products pass to you upon delivery of the product to the carrier. Sleepbiome Labs is not responsible for loss, theft, or damage that occurs after the carrier confirms delivery.
8. Returns and Refunds
Return and refund terms, including our 30-Night Deep Sleep Guarantee, are detailed in our Refund & Return Policy, which is incorporated into these Terms by reference. By placing an order, you agree to the terms outlined in our Refund & Return Policy.
Due to the nature of our product — a medical-grade adhesive strip applied directly to the face and mouth — opened packages cannot be returned for health and hygiene safety reasons.
9. Intellectual Property
All content on this Site — including but not limited to text, graphics, logos, images, product designs, photography, data compilations, software, and the overall design and layout of the Site — is the property of Sleepbiome Labs or its content suppliers and is protected by United States and international copyright, trademark, and intellectual property laws.
The Sleepbiome Labs name, logo, and all related product names, design marks, slogans, and trade dress are trademarks or registered trademarks of Sleepbiome Labs. You may not use, reproduce, or display any of our trademarks without prior written permission.
You may not reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, republish, download, store, or transmit any content from this Site without our express written consent, except for temporary caching by your web browser in the normal course of accessing the Site.
10. User Conduct
When using our Site, you agree not to:
- Use the Site for any unlawful purpose or in violation of any applicable local, state, national, or international law
- Attempt to gain unauthorized access to any portion of the Site, other accounts, computer systems, or networks connected to the Site
- Interfere with or disrupt the Site, servers, or networks connected to the Site
- Use any automated system, including bots, scrapers, or spiders, to access the Site for any purpose without our express written permission
- Submit false, misleading, or fraudulent information, including but not limited to false names, addresses, payment information, or product reviews
- Impersonate any person or entity, or falsely state or misrepresent your affiliation with any person or entity
- Upload or transmit viruses, malware, or any other harmful code
- Attempt to reverse-engineer, decompile, or disassemble any portion of the Site or its underlying technology
We reserve the right to terminate your access to the Site at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.
11. Product Reviews and User-Generated Content
By submitting a product review, testimonial, photograph, or any other content to our Site (“User Content”), you grant Sleepbiome Labs a non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such User Content in any media and for any purpose, including marketing and advertising.
You represent and warrant that you own or control all rights to the User Content you submit, that the content is accurate, and that use of your content does not violate these Terms or any applicable law and will not cause injury to any person or entity.
We reserve the right to remove any User Content at our sole discretion, for any reason, without notice.
12. Third-Party Links and Services
Our Site may contain links to third-party websites, services, or content that are not owned or controlled by Sleepbiome Labs. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that Sleepbiome Labs shall not be liable for any damage or loss caused or alleged to be caused by or in connection with the use of any third-party content, goods, or services.
13. Disclaimer of Warranties
THE SITE AND ALL PRODUCTS ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.
SLEEPBIOME LABS DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. SLEEPBIOME LABS DOES NOT WARRANT OR MAKE ANY REPRESENTATIONS REGARDING THE USE OR THE RESULTS OF THE USE OF THE PRODUCTS IN TERMS OF THEIR CORRECTNESS, ACCURACY, RELIABILITY, OR OTHERWISE.
YOUR USE OF THE SITE AND PURCHASE OF PRODUCTS IS AT YOUR OWN RISK. NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM SLEEPBIOME LABS OR THROUGH THE SITE SHALL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THESE TERMS.
14. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SLEEPBIOME LABS, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:
(A) YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE SITE OR PRODUCTS; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SITE; (C) ANY CONTENT OBTAINED FROM THE SITE; (D) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT; (E) ANY ADVERSE REACTION, INJURY, OR HEALTH CONSEQUENCE FROM THE USE OR MISUSE OF OUR PRODUCTS.
IN NO EVENT SHALL SLEEPBIOME LABS’ TOTAL LIABILITY TO YOU FOR ALL CLAIMS RELATING TO THE SITE OR PRODUCTS EXCEED THE AMOUNT YOU PAID TO SLEEPBIOME LABS FOR THE PRODUCT(S) GIVING RISE TO THE CLAIM DURING THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE LIABILITY.
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE EXCLUSIONS OR LIMITATIONS MAY NOT APPLY TO YOU, AND YOU MAY HAVE ADDITIONAL RIGHTS.
15. Indemnification
You agree to indemnify, defend, and hold harmless Sleepbiome Labs, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, or expenses (including reasonable attorneys’ fees) arising from:
(A) Your use of the Site or products; (B) Your violation of these Terms; (C) Your violation of any third-party right, including intellectual property, privacy, or other proprietary rights; (D) Any claim that your User Content caused damage to a third party.
This indemnification obligation will survive the termination of these Terms and your use of the Site.
16. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or the use of the Site or products shall be resolved exclusively in the state or federal courts located in Santa Clara County, California, and you consent to the personal jurisdiction of such courts.
17. Arbitration Agreement
Any dispute, claim, or controversy arising out of or relating to these Terms, the Site, or the products — including the determination of the scope or applicability of this agreement to arbitrate — shall be determined by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration shall take place in Santa Clara County, California, or at a mutually agreed location.
You agree that any arbitration shall be conducted on an individual basis and not as a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration against Sleepbiome Labs.
Notwithstanding the above, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of intellectual property rights.
18. Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving the original intent of the provision.
19. Entire Agreement
These Terms, together with our Privacy Policy, Shipping Policy, and Refund & Return Policy, constitute the entire agreement between you and Sleepbiome Labs regarding your use of the Site and purchase of products, and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral.
